The popularity of Delta-8 and Delta-10 THC is on the rise, especially in states where recreational cannabis is legal. If you live in Maine and want to order products infused with hemp-derived THC, you probably want to know if they are legal. If so, where to buy real and safe D-10 THC in the Pine Tree State? Let’s look at Maine’s hemp laws and regulations.
Is It Legal: Maine Delta-10 THC Laws
The short and simple answer is
Delta-10 THC is LEGAL in Maine.
What Is Delta-10 THC?
Delta-10 tetrahydrocannabinol (D-10 THC) is a new hemp-derived THC molecule that we know very little about. The effects and safety of this cannabinoid have yet to be explored by researchers, but anecdotal evidence shows that D-10 THC features more nootropic and energizing effects.
D-10 is an isomer of Delta-9 THC — they have an identical molecular formula but distinct arrangements of atoms in space. This cannabinoid is roughly half the potency of Delta-9 THC and is not known to cause the intense side effects (anxiety and paranoia) typical for classic THC. Compared to Delta-8 THC, which is more sedative, Delta-10 is more stimulating and promotes creativity and focus.

Hemp-derived Delta-10 THC products are legally sold in the Pine Tree State. That means you can probably find many Delta-8 THC and Delta-10 THC goods sold at local shops. But, taking steps to check the manufacturer, product reviews, and source of origin of hemp will allow you to stay safe and consume genuine D-10 THC concentrate.
D-10 THC is derived from hemp cannabidiol (CBD) and requires more processing than cannabinoids like Delta-8 THC. Meaning, not every vendor offers a properly developed, high-quality formula.

Continued, Is Delta-10 THC Legal in Maine?
Maine hasn’t explicitly banned the distribution and sale of hemp-derived Delta-10 THC.
Some states passed laws that restrict or ban the use and distribution of hemp-derived tetrahydrocannabinols — but not Maine. Delta-10 THC is legal in Maine when derived from the hemp plant versus marijuana.
The Pine Tree State updated its laws to comply with the 2018 Farm Bill and legalize hemp and hemp-derived products. Maine’s definition of hemp includes hemp cannabinoids, extracts, derivatives, and all products derived from hemp material, which in their final forms contain a delta-9 THC concentration of not more than 0.3 percent. Maine’s law clearly distinguishes “marijuana” from “hemp” and “hemp-derived products.” The law also permits individuals to grow up to three hemp plants for personal use.
Maine is one of the dozen states that legalized recreational marijuana. Both hemp-derived CBD and marijuana-derived CBD are legal in the Pine Tree State.
Delta-10 THC and Federal Law
If you’ve meant to buy Delta-10 THC, you’re probably wondering if it’s legal on a federal level?
Thanks to a loophole in the Hemp Farming Act, hemp-derived Delta-10 THC (and other forms of hemp THC) is unregulated at the federal level.
The Farm Bill legalized hemp as a plant of the cannabis family that contains less than 0.3% Delta-9 THC. These levels of THC are considered too low to cause a psychoactive effect, which was the main goal behind legalizing the hemp plant. Therefore, the appearance of hemp-derived tetrahydrocannabinols (THCs) revealed a loophole in the law that legalizes all hemp derivatives, cannabinoids, and extracts with less than 0.3% THC.
It’s important to note that, unlike naturally present cannabinoids, D-10 and other hemp-derived THCs cannot be extracted directly from the plant. As a result, chemists use chemical processes to convert hemp-CBD into Delta-10 THC. The conversion is not direct like it’s with Delta-8 THC, which makes this cannabinoid more heavily processed and, as a result, semi-synthetic. Because of this, D-10 could very easily be considered a controlled substance, despite being derived from the hemp plant.
In 2020, the U.S. Drug Enforcement Administration (“DEA”) released its Interim Rule that confirmed the illegal status of all “synthetically derived tetrahydrocannabinols.” The report doesn’t answer all of the issues related to the legality of these compounds. The industry expects clarification in the Final Rule, so, until release, D-10 THC remains in a legal gray area.
Maine doesn’t explicitly prohibit the distribution and sale of hemp-derived Delta-8 and Delta-10 THC. As of this writing, this substance is legal to buy in the Pine Tree State. In Maine, hemp and hemp-derived products with less than 0.3% THC are legal to buy.
