Is Reselling Hemp Flower Legal on a Federal Level?

The Food and Drug Administration (FDA) is working on regulating hemp CBD products, and the United States Department of Agriculture (USDA) has released the Interim Rule on Hemp in late 2019.

As of this writing, cannabidiol (CBD) is not allowed to be sold and marketed in food and dietary supplements or under health claims.

In accordance with the USDA’s Interim Rule, hemp is being tested for the total THC levels, which is the sum of delta-9 THC and the potential conversion of delta-9 tetrahydrocannabinolic acid (THCA) into THC.

New Mexico hasn’t banned or restricted the distribution and retail sale of hemp flower. 

You can resell CBD flower in New Mexico. The state legalized hemp under HB 581, known as the New Mexico Hemp Manufacturing Act. Under state law, the distribution and sale of hemp finished products is legal in New Mexico.

The New Mexico Environment Department adopted a Hemp Final Rule that has been effective since January 2020. The rule regulates hemp products and defines and authorizes the sale of “hemp finished product.”

Under the Rule, “hemp finished product” means “a hemp product that is intended for retail sale and contains hemp or hemp extract for human consumption, absorption, or inhalation that has a THC concentration of not more than three-tenths of one percent (0.30%).”

The New Mexico Final Rule requires finished products meant for inhalation to meet applicable state and federal labeling requirements [1].
