From a document issued by the New Hampshire Liquor Commission (updated in 2019), it’s clear that the state is following the FDA’s guidance on adding hemp CBD in food or marketing it as a dietary supplement. [1]

The document states that CBD oil as per the FDA’s Food Code is considered a food additive if added to food and beverages. 

The problem with CBD oil is that it’s not on the FDA’s Generally Recognized as Safe (GRAS) list, which means it is not allowed to be added to food or marketed as a dietary supplement.

Relating to the sale of hemp CBD products, the state has introduced House Bill 1581, which would impose testing and labeling requirements on processors. 

The bill was introduced in December 2019 and is still moving through the legislative process, so we’ll have to wait and see if this piece of legislation will be adopted.
