Michigan is the tenth state to legalize marijuana for recreational purposes and is considered a cannabis-friendly state. But full spectrum CBD oil in Michigan is a different story.
Despite making progress in the cannabis department and, at the same time, legalizing industrial hemp and CBD, the Great Lake State restricted the sale of hemp CBD products.
This is a problem for people interested in the best full spectrum CBD oil, also known as PCR hemp oil.
PCR (phytocannabinoid-rich) hemp oil is different than regular full spectrum CBD oil because it’s a whole-plant hemp extract that contains the entire hemp plant profile.
With PCR hemp oil, you are getting a potent, effective oil rich in phytocannabinoids, terpenes, vitamins, omega acids, and other nutrients found in hemp.
If you need a CBD oil that truly works, PCR hemp oil won’t disappoint you.
Is full spectrum CBD oil with less than 0.3% THC legal to buy in Michigan? Let’s take a look.
Is Full Spectrum CBD Oil Legal in Michigan?
Michigan is one of the states that follow federal rules regarding the commercial sale of hemp CBD products in food and as dietary supplements. Meaning, PCR hemp oil with less than 0.3% THC is illegal in Michigan.
The only hemp substances safe to add to food in this state are hulled hemp seeds, hemp seed protein, and hemp seed oil — considered GRAS (Generally Regarded As Safe) by the FDA. [1]
The Michigan Department of Licensing and Regulatory Affairs offered guidance on CBD and industrial hemp, stating that:
“Products derived from industrial hemp, including CBD oil, fall under several different categories. Any substance that will be added to food or drink or marketed as dietary supplement must be approved by the U.S. Food and Drug Administration for that intended use. At this time, the FDA has not approved CBD for use in food or drink or as a dietary supplement. Therefore, it is currently illegal to add CBD into food products or drinks or sell it as dietary supplements. “
In December 2018, Governor Snyder signed into law three bills (HB 6330, 6331, 6380), which authorize the creation of a new Industrial Hemp Research and Development Act and exclude the definition of hemp from the definition of marijuana. [1]
Under the Act, the Michigan Department of Agriculture and Rural Development is in charge of overseeing and regulating the growing, processing, and handling of industrial hemp.
Despite the progress made, these new laws will go into effect after USDA approves Michigan’s state plan, and the state Department of Agriculture adopts the hemp rules.
