Furthermore, “The addition of such a derivative [in this case, hemp-derived cannabidiol] shall not be considered an adulteration of the product, unless otherwise provided in applicable federal law.”

Until Iowa’s hemp plan gets approved, the sale of PCR hemp oil remains murky in this state. 

To clarify the legality of hemp-CBD in Iowa, the state Attorney General, Miller, issued a Statement on Hemp and CBD Products. 

According to the statement, “no one can grow, manufacture, or process hemp in Iowa, outside of the two mCBD manufacturers licensed by the Iowa Department of Public Health.” [2]

Furthermore, “until the coordinating amendments of the Iowa Hemp Act are effective, any product sold over-the-counter containing CBD or THC technically falls within the definition of marijuana and is considered a Schedule I controlled substance.”

Hemp products allowed in Iowa include, but are not limited to “any item manufactured from hemp,” such as cloth, cordage, fiber, food, fuel, paint, paper, particleboard, plastic, hemp seed, seed meal, or seed oil. 

Hemp seeds capable of germination and hemp products with a THC concentration higher than 0.3% do not fall under the definition of “hemp product.”

Is It Legal to Ship PCR Hemp Oil to Iowa?

Under the 2018 Farm Bill, the USPS allows licensed manufacturers to mail hemp-CBD products with less than 0.3% THC as long as they follow their criteria. 

Iowa has yet to issue regulations elaborating on what is required to transport hemp-CBD products into the state.
