Is Hemp Flower Legal in North Carolina?

Yes, hemp flower with less than 0.3% THC is legal in North Carolina.

North Carolina had a complicated relationship with smokable hemp due to attempts to ban those products.

In 2019, North Carolina passed a bill that legalized hemp as a viable agricultural commodity in the state. After the provisions of the bill expired, the hemp industry was on the verge of collapse in North Carolina before legislators passed the last-minute SB 455 [1].

The newest hemp bill (SB 455) was signed by the governor in June 2022. It excludes hemp and hemp products from the definition of marijuana and the state’s Controlled Substances. The bill defines hemp as:

“The plant Cannabis sativa (L.) and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than three-tenths of one percent (0.3%) on a dry weight basis.” [1]

Under North Carolina law, hemp growers must obtain a grower’s license from the U.S. Department of Agriculture. A grower can cultivate their own hemp and not resell to another processor, but process it into products themselves. Hemp processors in North Carolina don’t need a license to process hemp.
