Tennessee Hemp Laws
Tennessee updated its hemp law under SB 378, passed in 2023, which regulated hemp-derived products.

The two main bills relevant to cannabis enacted in Tennessee before the 2018 Farm Bill are Senate Bill 2125 and House BIll 2144.

The second bill allowed the manufacture and possession of cannabis with .9% THC by patients with epilepsy who enrolled in clinical research that investigated the medical benefits of the cannabis plant.

The 2018 Farm Bill legalized the growth, manufacture, and sale of hemp and hemp products with less than 0.3% delta 9 THC.
If you’ve been following the progress of hemp laws and regulations, you know that the 2018 Farm Bill legalized the hemp plant and its cannabinoids. The main distinction between hemp and federally illegal marijuana is the level of Δ9-THC they contain.
Federal law removed hemp from the Controlled Substances Act
Federally, hemp plant and hemp-derived products cannot contain over 0.3% delta 9 THC by weight. Federal law defines hemp broadly:
“The term ‘hemp’ means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis [1].”
When the 2018 Farm Bill legalized this plant, it removed it from the list of Controlled Substances. Marijuana, on the other hand, is still a scheduled substance federally, though some states have decided to decriminalize or legalize it for recreational purposes.
One of the main hurdles around the hemp industry is the distribution and sale of consumable products. Namely, the US Food and Drug Administration hasn’t approved the use of cannabinoids like cannabidiol (CBD) in edibles or dietary supplements.
This hasn’t stopped manufacturers from selling these products or states from regulating them. The only requirement is that they don’t market them under health claims or as dietary supplements.
While this question is still under investigation by the FDA, opponents to the legality of high-THC hemp-derived products claim that such products cannot be legal because they are intoxicating.
It’s true that this clashes with the original idea behind hemp’s legalization as a non-marijuana-like plant. But, the main distinction between these plants and products derived from them is rooted in the levels of Δ9-THC they contain. Therefore, if a product contains less than 0.3% delta 9, it’s perfectly legal under federal law regardless if it’s intoxicating or not.
