Iowa used to classified CBD under Schedule I controlled substances. That all changed after the USDA officially approved Iowa’s hemp production plan.
The state published an office notice on April 8, 2020, declaring non-THC hemp derivatives like CBD no longer a Schedule I controlled substance. This means that hemp-derived CBD products with no more than 0.3% delta 9 (as defined under federal law) are legal in Iowa.
The state soon opened a Consumable Hemp Regulatory Program for hemp manufacturers and retailers. On March 3, 2021, the Department of Inspections and Appeals (DIA) enacted administrative rules legalizing the processing, manufacture, and retail sale of hemp products for human consumption.
Individuals and business entities are not allowed to sell consumable hemp products until they’ve received approval. State law defines “consumable hemp” as “a product introduced into the human body by ingestion or absorption.”
Furthermore, Iowa law provides guidelines for testing and packaging consumable hemp products, including the need for disclosing the specific cannabinoids and milligrams per serving and serving size. The only hemp products banned in the Hawkeye State are vapes and smokables.

What is Hemp-Derived Delta 9 THC?
Delta 9 THC is a hemp cannabinoid present in the plant in a concentration of no more than 0.3% by dry weight. When Congress passed the Farm Bill of 2018, hemp and its cannabinoids became legal federally.
Therefore, when extracted from the flowers of hemp with no more than 0.3% THC, this cannabinoid is considered legal. On the other hand, THC derived from marijuana is a controlled substance. Legal Delta 9 THC and Federal Law
Hemp and marijuana are cannabis varieties with vastly different chemical profiles and THC levels. The marijuana plant is high in THC and is available in high potency strains that are highly psychotropic and stimulating.
Hemp is the non-intoxicating Cannabis sativa variety that was legalized under the 2018 Farm Bill. The main difference between the two is that hemp contains no more than 0.3% delta 9 THC. The bill defines hemp as:
“The plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis [1].”
