Nebraska holds more conservative views on cannabis, considering the state only recently introduced medical marijuana legislation. But, that didn’t stop the sprouting of smoke shops and specialty stores that offer Delta-10 THC in the Cornhusker State. Is Delta-10 THC legal in Nebraska? If so, where to purchase the best products? Let’s look at the state’s hemp laws and regulations.
Is It Legal: Nebraska Delta-10 THC Laws
The short and simple answer is
Delta-10 THC is LEGAL in Nebraska.
What Is Delta-10 THC?
Delta-10 tetrahydrocannabinol (D-10 THC) is a newly discovered cannabinoid present in the hemp plant in insignificant concentrations. To obtain D-10 THC in large quantities, chemists modify the cannabidiol (CBD) molecule using various chemicals in the process. You will get a “high” from using D-10 THC, but not in the same way as with Delta-8 and Delta-9 THC.
If you’ve ever tried Delta-9, you know that its intoxication is followed by anxiety, discomfort, paranoia, and sometimes hallucinations. Delta-10 THC is twice less potent than this compound and doesn’t cause a surge of uncomfortable feelings. While D-10 is close in potency to Delta-8 THC, they are on the opposite side when it comes to effects. Delta-8 is soothing and suitable for nighttime use, and D-10 is uplifting and best for daytime use.

Continued, Is Delta-10 THC Legal in Nebraska?
Nebraska hasn’t explicitly banned the distribution and sale of hemp-derived Delta-10 THC products.
In fact, Delta-8 and Delta-10 THC products are hot sellers in Nebraska. The Cornhusker State enacted hemp laws and regulations shortly after the passage of the 2018 Farm Bill. The state’s laws broadly legalized hemp and labeled hemp material as an agricultural commodity to be grown, processed, and marketed.
Nebraska’s hemp law legalized the plant and all hemp derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers with a Delta-9 THC concentration of less than 0.3 percent.
The Cornhusker State clearly distinguishes the definition of hemp from the definition of marijuana. In its Controlled Substances Act, the state prefaces the meaning of hemp before stating that cannabis tetrahydrocannabinols, its isomers, and synthetic derivatives are illegal. Therefore, Delta-10 THC products are legal but unregulated in this state.
Nebraska’s stringent views towards cannabis are noted with the recent introduction of medical marijuana legislation on March 30, 2021. The state’s late introduction to medical cannabis may signify a strong likelihood to pass legislation that bans hemp-derived THCs in the future. But, nothing has been discussed publicly yet.
Delta-10 THC and Federal Law
Is Delta-10 THC legal on a federal level?
In late August 2020, the Drug Enforcement Administration (DEA) releaed an Interim Final Rule that threatened the newly developed Delta-8 THC market by addressing the legality of “synthetically derived tetrahydrocannabinols.”
The rule stated that for “synthetically derived tetrahydrocannabinols” the concentration of Delta-9 THC is not a determining factor in the legality of the material. The rule doesn’t expressly define “synthetically derived THC,” and in a 2017 Resource Guide, the DEA states that “synthetic cannabinoids are not organic, but are chemical compounds created in a laboratory.”
Although the rule doesn’t clearly define the term “synthetic,” there is a high probability that it would deem hemp THCs like Delta-8 and Delta-10 illegal federally. That is, with a complete disregard of the 2018 Farm Bill, which legalized hemp and hemp derivatives, aka substances made from another substance.
It’s clear that the situation regarding the legality of Delta-10 is very complicated, mainly because the Farm Bill doesn’t support the Interim Rule. To make things even more complex, D-10 THC is an intoxicating cannabinoid, and it’s clear that the Farm Bill didn’t intend to legalize intoxicating cannabinoids, hence the 0.3% Delta-9 THC limit on hemp material and finished products.
That said, the situation is expected to be cleared with the release of the Final Rule. Until then, D-10 remains in a gray legal area.
