Oklahoma hasn’t expressly banned the manufacture and sale of hemp-derived Delta-10 THC products.

The Sooner State legalized hemp and all hemp derivatives, extracts, cannabinoids, isomers, acids, salts and salts of isomers with a THC concentration of 0.3 percent or less. 

An important update to state law was the exemption of hemp from the definition of marijuana. The Oklahoma Public Health Code specifies that hemp tetrahydrocannabinols are not classified as controlled substances, as opposed to tetrahydrocannabinols derived from marijuana. So, as long as Delta-10 THC has been derived from hemp instead of marijuana, it’s legal in the state. 

Oklahoma permits conducting the retail sale of hemp and hemp products without a license if the products were grown and cultivated legally in the state or another state or jurisdiction and meet similar requirements for growing hemp or processing hemp products.

The other argument is that D-10 THC is created in a lab, which makes it semi-synthetic. Through chemical synthesis and the use of catalysts, chemists convert hemp-derived cannabidiol (CBD) into Delta-9 THC and into Delta-10 because that’s an easier route to isolating the compound.
