This could classify it as synthetic THC, at least, according to the Interim Rule issued by the Drug Enforcement Administration (DEA) in August 2020.
The rule stated that “all synthetically derived tetrahydrocannabinols remain Schedule I controlled substances.” The rule is not final, which leaves space for debate on whether legislators will decide to prohibit or regulate the sale of this cannabinoid.
From the language presented in the report, there’s no exact definition of what synthetic tetrahydrocannabinol encompasses. When comparing Delta-10 THC and synthetic THC like Spice and K2, we can notice that they are not even close to being similar.
Delta-10 THC is created in a lab with hemp CBD as the starting material while the process of creating synthetic THCs doesn’t involve any cannabis compounds or plant material. Also, synthetic THC is known to cause serious side effects that are different from those of marijuana.
While it’s true that this substance is derived from hemp, there’s a component to it that makes it synthetically derived. This unusual position of D-10 puts it in a legal gray area.
