As of this writing (07/13/2021), Illinois law doesn’t explicitly prohibit the distribution and sale of Delta-10 THC.

The state is actively pursuing regulation of all hemp-derived products, including cannabidiol (CBD). State representatives proposed a bill that would regulate Delta-8 THC, CBD, and cannabinoid products and ensure product safety. If passed, the legislation would require testing and labeling cannabinoid products, like CBD, before distribution.

The executive director of the Cannabis Business Association of Illinois has also been advocating for the regulation of D-8 THC and similar isomers. But, until the bill is enacted and regulations are in place, shops continue to offer Delta-8 THC and Delta-10 THC in Illinois. 

In 2019, the Prairie State became the first state to legalize cannabis through legislation rather than a ballot initiative. The sales of recreational cannabis started January 1, 2020. 

Delta-10 THC and Federal Law 

The legality of Delta-10 THC on a federal level is even more complicated than the legality of Delta-8 THC. 

As a hemp-derived cannabinoid, D-10 THC falls under the 2018 Farm Bill, which legalized the hemp plant and all hemp cannabinoids, extracts, derivatives, and isomers. But, because it’s almost non-existent in the hemp plant, chemists create it in a lab. They take hemp-derived cannabidiol (CBD) and convert it into Delta-10 THC. 

Processors use several methods to perform this conversion, some of which may leave toxic and harmful by-products in the final item. Trusted brands use safe manufacturing practices, but not every brand has a developed formula. That’s why it’s key to ask for lab reports of the product you’re buying. 

Although derived from compounds naturally occurring in hemp, D-10 THC is processed more heavily than Delta-8 THC. Chemists typically rearrange the molecules of hemp-CBD or hemp-derived Delta-9 THC to create this cannabinoid. This could classify it as synthetic THC, at least, according to the Interim Rule issued by the Drug Enforcement Administration (DEA) in August 2020.

The rule stated that “all synthetically derived tetrahydrocannabinols remain Schedule I controlled substances.” The rule is not final, which leaves space for debate on whether legislators will decide to prohibit or regulate the sale of this cannabinoid. 

From the language presented in the report, there’s no exact definition of what synthetic tetrahydrocannabinol encompasses. When comparing Delta-10 THC and synthetic THC like Spice and K2, we can notice that they are not even close to being similar. 

Delta-10 THC is created in a lab with hemp CBD as the starting material while the process of creating synthetic THCs doesn’t involve any cannabis compounds or plant material. Also, synthetic THC is known to cause serious side effects that are different from those of marijuana.  

While it’s true that this substance is derived from hemp, there’s a component to it that makes it synthetically derived. This unusual position of D-10 puts it in a legal gray area.
