Governor Eric Holcomb signed Senate Bill 52 back in March 2018. The new law allowed the sale of hemp CBD for commercial purposes as long as the product contains less than 0.3% delta 9 THC by weight. 

Under this bill, the consumption and sale of CBD products is allowed if the packaging includes a QR code linked to a document that contains information like: 

  • Batch number
  • Total batch size
  • Product name
  • Manufacturer name
  • List of ingredients
  • Number of milligrams of CBD
  • Certification of analysis 
  • A statement that the product contains no more than 0.3% THC by weight

Smokable hemp products are banned in Indiana, but the state has no issue with oils, tinctures, and edibles with no more than 0.3% delta 9 THC. 

Indiana was historically an anti-cannabis state, but it gradually passed laws that made it more open to producing hemp-derived products. 

After the 2014 Farm Bill, Governor Pence signed IC 15-15-13 (the Industrial Hemp Act) into law, authorizing the cultivation of industrial hemp for research purposes. Under this bill, the Office of the Indiana State Chemist and Seed Commissioner provided licenses for the cultivation of this crop. At this early stage, consumers didn’t have access to hemp products.

In 2017, Governor Holcomb signed House Bill 1148, which legalized the use of CBD oil with less than 0.3% total THC for eligible patients with epilepsy and uncontrollable seizures. The state has yet to establish a proper medical marijuana program, so CBD derived from cannabis is illegal for medicinal and recreational purposes.

“The term ‘hemp’ means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis [1].”

The main thing that hinders the legality of these products is that they’re intoxicating. Delta 9 gummies can contain 10mg to 12mg of delta 9 per gummy and cause mild intoxication. The initial idea behind hemp’s legalization was to allow the growth and distribution of a non-intoxicating cannabis variety and its products.
