Since hemp has become a legal crop in the U.S., the Food and Drug Administration (FDA) and the United States Department of Agriculture (USDA) have been working on regulating hemp CBD products and the cultivation of hemp, respectively.

The FDA is still investigating the potential benefits and side-effects of hemp CBD, so products like smokable hemp CBD flower remain unregulated on a federal level. Under federal law, prohibited activities regarding hemp CBD is adding the compound in food, dietary supplements, or marketing it under medical claims. 

On hemp cultivation, the USDA released its Interim Rule, which set requirements for testing of hemp’s total THC levels. The total THC levels include delta-9 THC and the potential conversion of delta-9 tetrahydrocannabinolic acid (THCA) into THC.

Farmers have been given the following year to adjust to the testing requirements before the USDA releases the final rule. Still, in general, the testing requirements received a lot of industry backlash. New Jersey won approval on its hemp plan by the USDA, and the new plan incorporates the total THC testing rule imposed by the USDA.

New Jersey has legalized hemp products, so they are not considered controlled substances because of the presence of hemp-derived cannabinoids, such as cannabidiol. 

The retail sale of hemp products is permitted under AB 5322 (New Jersey Hemp Farming Act) and AB 1330, except for CBD in foods and beverages. Retailers can also offer hemp CBD products processed outside of New Jersey  if the state’s cultivation requirements are similar to Jersey’s. Also, the products must be tested for their THC levels.
