The Hemp Final Rule has been effective since January 28, 2020, and regulates the process of getting a permit to operate a hemp facility for the production of hemp products.  

The Hemp Final Rule defines “hemp extract” as “oil and extracts, including cannabidiol, cannabidiolic acid, and other identified and non-identified compounds from hemp.” [1]

The Rule also permits the sale of “hemp finished product” defined as “a hemp product that is intended for retail sale and containing hemp or hemp extracts for human consumption, absorption, or inhalation that has a THC concentration of not more than three-tenths on one percent (0.30%).” [1]

It seems that the state has aligned its rules with the FDA’s policy on adding CBD to food and food products. The state’s final rules removed “food and food additives” that were initially mentioned in the “Emergency Rules.” 

The New Mexico Environment Department’s Environmental Health Bureau (NMED) is in charge of issuing permits for hemp warehouses, extraction facilities, manufacturing and processing facilities. 

The state doesn’t require individuals to obtain a permit to sell pre-packaged CBD or other hemp products. But, the state recommends that the pre-packaged products come from a licensed business by a proper state authority.

The New Mexico Final Hemp Rules include various labeling and testing requirements that hemp finished products must comply with before being transported, distributed, or sold to consumers.

The hemp facility shall create and utilize hemp transportation manifest to transport hemp products. The transportation manifest shall contain various information such as a permit, shipping date, facility name, address, and more.

The rules do not include shipping of “hemp finished product” directly to consumers. But, the USPS allows manufacturers to mail small quantities of hemp CBD products directly to consumers. The products have to be made by a licensed manufacturer, contain less than 0.3% THC, and comply with state and federal laws.

2019 — HB 581

In April 2019, New Mexico Governor Michelle Lujan Grisham signed HB 581, also known as the Hemp Manufacturing Act. The Act provides a regulatory framework for the production of hemp CBD products and the emerging hemp industry. 

2017 — SB 6

In 2017, New Mexico lawmakers enacted Senate Bill 6, which was initially vetoed by Gov. Martinez but later overturned by the Supreme Court. The bill provided authorization for the New Mexico Department of Agriculture to adopt rules for research on industrial hemp and established the Hemp Research and Development Fund. 

2015 — SB 94 

Senate Bill 94 is an Act which provided for licensing the growing, selling, and processing of industrial hemp.
