Kansas law banns hemp smokable products, teas, liquids, solids, and other hemp products for human consumption, but doesn’t explicitly ban (or allow) the use of hemp CBD in hemp products. 

In 2019, Governor Colyer signed Senate Substitute for House Bill 2167, which establishes the Commercial Industrial Hemp Program under the 2018 Farm Bill. [1]

The bill authorizes the sale of hemp and hemp products with less than 0.3% THC for commercial purposes. Under the bill, hemp and hemp products are no longer considered controlled substances. 

This bill requires the Kansas Department of Agriculture to submit a plan to the U.S. Department of Agriculture  regarding commercial production of hemp in the state. 

Kansas is waiting on the approval of its hemp plan by the USDA, after which “new legal authority and regulations will need to be adopted before Kansas can create a commercial program.”

Until then, the Department of Agriculture is issuing hemp licenses (grower licenses, distributor licenses, processor licenses, and state educational institution licenses) under the Industrial Hemp Research Program authorized by the Alternative Crop Research Act.

A Short Overview of Hemp CBD Laws in Kansas

2019 Senate Substitute for HB 2167

In April 2019, Governor Colyer signed Senate Substitute for HB 2167 into law. This bill authorizes the commercial sale of hemp and hemp products with less than 0.3% THC in compliance with the 2018 Farm Bill. Under the law, hemp and hemp products are not considered controlled substances. 

2018 Senate Bill 263

In April 2018, Governor Colyer signed SB 263, which enacted the Alternative Crop Research Act. The Act allowed the Kansas Department of Agriculture to  oversee the Industrial Hemp Research Program under the 2014 Farm Bill.  

Is It Legal to Ship PCR Hemp Oil to Kansas?

According to the USPS, licensed manufacturers can mail hemp-CBD products with less than 0.3% THC as long as they comply with their rules. 

Kansas does not provide regulations regarding the transport of hemp-CBD products with less than 0.3% THC. 

Regarding the transport of hemp in general, Kansas law requires individuals to obtain a research distributor license. The Department of Agriculture and other hemp laws don’t address the transporting issue in Kansas.
