Is Hemp Flower Legal in Washington?

Yes, CBD hemp flower with no more than 0.3% THC is legal in Washington. 

But, it can only be sold by licensed cannabis dispensaries. This doesn’t affect you, the consumer, as you can still lawfully buy smokable hemp in this state.

Under Washington’s new regulations, products containing ‘detectable levels’ of THC, including CBD products with less than 0.3% THC, can be sold only by stores licensed by the Washington State Liquor and Cannabis Board.

Under the new state regulations (SB 5367), a “cannabis product” means:

“Any product intended to be consumed or absorbed inside the body by any means including inhalation, ingestion, or insertion, with any detectable amount of THC.”

This means that CBD products derived from hemp, like full spectrum CBD oil with less than 0.3% THC, are now considered cannabis. Therefore, they can be lawfully sold in Washington only by licensed dispensaries.

Re-Defining Hemp Products

Furthermore, the new law re-defines the term ‘hemp consumable,’ which means “a product that is sold or provided to another person that:”

  • is made of hemp

  • is not a ‘cannabis product’ as defined under the new regulations, and

  • is intended to be consumed or absorbed inside the body by any means, including inhalation, ingestion, or insertion.

This means that a ‘hemp consumable’ under the new Washington State regulations means a hemp product with no THC levels.

CBD flower and smokable hemp products now fall into the category of ‘cannabis product’ in Washington because they are meant for inhalation and contain detectable amounts of THC (less than 0.3%).

As a result, the only products that can be sold by non-licensed hemp retailers (both in-store and online) are THC-free CBD products, topicals, and FDA-approved products like hemp seeds and hempseed oil.

The state legalized hemp under SB 5276 in 2019, which replaced the industrial hemp research program and authorized the growth of hemp as a legal, agricultural activity in the state. 

Under state law, “hemp” means:

“The plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis [1].

In Washington, hemp can be legally grown, produced, processed, possessed, transferred, commercially sold, and traded within the state, outside of the state, and internationally under the laws of other states.
