Under the state law,
“‘industrial hemp’ means the plant Cannabis sativa L. and any part of that plant, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis that has been cultivated under a license issued under this Act or is otherwise lawfully present in this State, and includes any intermediate or finished product made or derived from industrial hemp.” 
The bill excludes hemp from the definition of marijuana and adds that hemp and hemp products are presently legal to possess or own.
It is interesting how Illinois legalized hemp for commercial purposes even before the 2018 Farm Bill was passed. The former Illinois Governor Bruce Rauner signed the state’s Industrial Hemp Act, which legalized the growth of hemp.
At that point, more than 10 other states have legalized industrial hemp. The 2018 Farm Bill was passed in December, paving the way for Illinois and other states to transport and sell their hemp products in other states.

2018—Senate Bill 2298
This bill created the Industrial Hemp Act in Illinois. The bill was signed into law by Gov. Rauner on August 26th and allowed farmers to grow, cultivate, or process industrial hemp products by getting a license issued by the Department of Agriculture. 
2017—Senate Bill 1294
This bill created the Industrial Hemp Act allowing any person to grow, process, harvest, possess, sell, or purchase hemp. 
Is CBD Legal to Buy in Illinois?
You can legally buy hemp-derived CBD in Illinois.
The Illinois law doesn’t specifically state the legality of cannabidiol as a compound like other states which have included CBD in the legal definition of hemp. However, the law legalized “any intermediate or finished products made or derived from industrial hemp.” 
This means that CBD would fall under this segment of the legal definition. So, as long as hemp-derived CBD products contain less than 0.3% THC, they are legal to buy in this state.
Marijuana Is Legal in Illinois
Illinois legalized marijuana for recreational purposes and became the 11th state on the list. Illinois is the first state where the state legislature legalized selling marijuana.
The bill will allow adults 21 and older to buy, sell, and possess marijuana for recreational purposes starting January 1, 2020. Illinoisans can possess up to 30 grams of cannabis flower, 5 grams of cannabis concentrate, and 500 milligrams of THC.
