The Georgia Department of Agriculture has developed the Georgia Hemp Plan to regulate production in the state. It was approved by the USDA to provide Hemp Grower License for individuals who want to cultivate and handle hemp in Georgia.

In February 2019, Georgia lawmakers proposed legislation that allowed for the growing and processing of hemp in the state. The bill came under scrutiny by the public due to the high proposed fees for growers and processors.

The state has put out excessive hemp processor permit fees. So, processors who are interested in working with hemp must pay an application fee of $5000 and an annual license fee as high as $25,000.

Growers must pay $50 per acre of land. Also, when hemp processors want to renew their licenses, they must pay a $10,000 yearly fee.

The state also requires growers and processors to set up contracts and limits the transfer of goods. Georgia’s hemp law is pretty limiting and strict. It only opens its application for licensing every January 1, and is only valid until December 31 of the year of application.

Lastly, growing hemp itself must follow certain rules created by the GDA. Hemp growers must use GDA-approved pesticides, submit sampling for approval to an agent, pay all testing or lab fees, and dispose of or remediate unapproved hemp plants.
