  • Due to a lack of funding, Alaska’s Hemp Pilot Program never took off.

Is Hemp Flower Legal in Alaska?

Yes, CBD flower with less than 0.3% THC is legal in Alaska.

Smokable hemp products derived from hemp with a THC concentration of no more than 0.3% by dry weight are also permitted in Alaska.

However, CBD flower and smokable hemp remain unregulated in this state. Alaska legalized hemp under SB 6 in 2018, authorizing the creation of an industrial hemp pilot program.

Unfortunately, Alaska officials cut funding for the state hemp program, stating there is “no existing industry to support a state-funded program.”

Although hemp CBD sales are high in the Last Frontier, both hemp flower and hemp CBD remain unregulated under state law. The absence of state regulations leaves Alaska’s hemp industry subject to federal regulations.

Under state law, industrial hemp is separated from marijuana and defined as “all parts and varieties of the plant Cannabis sativa L. containing not more than 0.3% of delta-9-tetrahydrocannabinol (THC).”

This means that as part of hemp, CBD flower is automatically permitted as long as it contains less than 0.3% THC.

A Short Overview of Alaska Hemp/CBD Laws

Here is a short overview of significant Alaska hemp laws:

2018: An Act Relating to the Regulation and Production of Industrial Hemp (SB 6)

In April 2018, Alaska passed Senate Bill 6 (SB 6), in compliance with the 2014 Farm Bill, “to study the growth, cultivation, [and] marketing of industrial hemp.”

The bill excluded hemp from the definition of marijuana as well as cannabidiol oil from the definition of ‘hashish oil [1].’

2017: HB 172

This 2017 Act also related to the regulation and production of hemp and hemp pilot programs; the bill clarified that “adding industrial hemp to food doesn’t create an adulterated food product [2].”

2015: SB 8

With the 2015 Act, Alaska set the foundation for regulation and production of industrial hemp. The Act legalizes hemp and its production as an agricultural crop in the state [3].

Is CBD Oil Legal in Alaska?

Yes, CBD oil derived from hemp with a THC concentration of no more than 0.3% is legal in Alaska.

This includes broad spectrum and full spectrum CBD oil. The sale of CBD in food and beverages is murky because the state law is in compliance with federal law.

The state’s CBD industry is largely unregulated, so there is a risk that the products offered may not contain the same levels of CBD listed on the label.

So, it’s important to only buy from reliable sellers that can prove the authenticity behind their products (third-party lab results) and not random brands.

Current law excludes CBD oil from ‘hashish oil,’ and is defined as “the viscous liquid concentrate of cannabidiol extracted from the plant (genus) Cannabis containing not more than 0.3 percent delta-9-tetrahydrocannabinol [1].”

Many states, including Alaska, are in a grey zone regarding the regulation of CBD and hemp. However, they still retain a friendly approach. Read below how to make the right hemp flower purchase.
