Are Delta 9 THC Gummies Legal in New Jersey?

New Jersey’s state law is vague when it comes to adding CBD to food products.

The state doesn’t explicitly restrict the sale, use and possession of hemp-derived gummies with less than 0.3% THC, but it limits them to the extent of federal regulations.

According to the New Jersey Cannabis Regulatory Commission, “CBD products fall under the regulatory category of the FDA.” In addition, the state prohibits the sale of weed-infused edibles, with the exception of “ingestible cannabis-infused products” like gummies.

So, marijuana gummies are legal in New Jersey, but the state doesn’t regulate hemp gummies the same way. Again, they are not explicitly prohibited, so we can assume that they can be lawfully sold in this state.

New Jersey Hemp Laws

New Jersey didn’t wait too long to establish its own state hemp program after the passage of the 2018 Farm Bill.

The state had already started the process of legalization of hemp governed under the 2014 Farm Bill. In November 2018, New Jersey lawmakers passed New Jersey Assembly Bill 5322.

This bill set the state’s pilot program and adopted the federal standard for THC concentration in hemp less than 0.3 percent.

Under state law, all forms of hemp-derived CBD products are legal in New Jersey, as long as they contain delta 9 THC concentration of no more than 0.3 percent by weight. The definition includes cosmetics, personal products, foods and drinks.    

New Jersey is one of the 15 states to legalize adult-use cannabis. In August 2021, Governor Murphy signed the bill that approved possession of marijuana for adults 21 and older.

What is Hemp-Derived Delta 9 THC?

As a major cannabinoid, Δ9-THC is present in both cannabis varieties: hemp and marijuana. From a legal perspective, hemp contains no more than 0.3 percent delta 9 by dry weight. Some marijuana strains, on the other hand, reach up to 25% delta 9 THC. 

Delta 9 THC is one of the most popular, naturally occurring cannabinoids in the cannabis plant. This compound stimulates the brain and causes an intoxication known as a “high.” But, it also possesses potent medicinal benefits and can help with pain, anxiety, depression, inflammation, sleep and appetite. It shines best when combined with other cannabinoids and terpenes. 

Hemp Compliant Delta 9 THC and Federal Law

The 2018 Farm Bill legalized the growth, manufacture, and sale of hemp and hemp products with less than 0.3% delta 9 THC.

Hemp was removed from the Controlled Substances Act

The Farm Bill of 2018 was not the typical farm bill because it planted the seeds of the new hemp industry. The bill removed hemp from the Controlled Substances Act and the definition of marijuana. For decades, cannabis plants were illegal under the Marijuana Tax Act, so federal law didn’t differentiate hemp from marijuana. 

After the legalization of the plant, hemp with no more than 0.3 percent delta 9 THC was no longer considered a scheduled substance. Hemp is defined as: 

“The term ‘hemp’ means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis [1].”

One of the most important steps that made the development of the hemp industry possible was that the bill removed “THC in hemp” from the Controlled Substances Act. Marijuana continues to be an illegal substance federally, but federally compliant hemp-derived products with higher THC content are legal. 

The main issue around products like legal Δ9-THC gummies is that they are intoxicating. 

However, the level of Δ9-THC in a product or hemp material is the only “metric” that separates hemp from marijuana in terms of legality. So, regardless if a product is intoxicating, if it comes from federally compliant hemp and contains less than 0.3% delta 9 THC, it’s legal under federal law. 

In fact, the legal status of CBD is still more complicated because the Food and Drug Administration (FDA) hasn’t approved the use of this component in hemp-derived consumable products. That said, the FDA tolerates the sale of CBD in food and dietary supplements as long as they’re not marketed under any medical claims.
