  • A statement that the product contains no more than 0.3% THC by weight

Smokable hemp products are banned in Indiana, but the state has no issue with oils, tinctures, and edibles with no more than 0.3% delta 9 THC. 

Indiana was historically an anti-cannabis state, but it gradually passed laws that made it more open to producing hemp-derived products. 

After the 2014 Farm Bill, Governor Pence signed IC 15-15-13 (the Industrial Hemp Act) into law, authorizing the cultivation of industrial hemp for research purposes. Under this bill, the Office of the Indiana State Chemist and Seed Commissioner provided licenses for the cultivation of this crop. At this early stage, consumers didn’t have access to hemp products.

In 2017, Governor Holcomb signed House Bill 1148, which legalized the use of CBD oil with less than 0.3% total THC for eligible patients with epilepsy and uncontrollable seizures. The state has yet to establish a proper medical marijuana program, so CBD derived from cannabis is illegal for medicinal and recreational purposes.   

What is Hemp-Derived Delta 9 THC?

The cannabis plant contains over 60 different cannabinoid molecules — and delta 9 THC (or THC) is the most recognized due to its psychotropic effects. THC attaches to the body’s cannabinoid receptors found in the brain and nervous system and causes an intoxication. 

This cannabis compound occurs in hemp in less than 0.3% as per the legal threshold set by the Farm Bill. So, when extracted from the buds and flowers of federally compliant hemp, delta 9 is a legal component. Research shows that THC has a number of benefits and can help with inflammation, pain, and insomnia. 

Legal Delta 9 THC and Federal Law

“The term ‘hemp’ means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis [1].”
