No, gummies infused with THC are not legal in Georgia. 

Georgia allows the manufacture, distribution, and sale of hemp products with less than 0.3% THC with the exception of food. The state defines ‘hemp products’ as:

“All products with the federally defined THC level for hemp derived from, or made by, processing hemp plants or plant parts that are prepared in a form available for legal commercial sale, but not including food products infused with THC unless approved by the United States Food and Drug Administration [1].

The state passed the Georgia Hemp Farming Act (HB 213) in May 2019, which formally legalized the commerce of CBD products with less than 0.3% THC.

Georgia’s hemp law defines THC as tetrahydrocannabinol and tetrahydrocannabinolic acid (THCA), which is on par with the federal definition of THC. 

Hemp Laws in Georgia

Until the passage of HB 213, people had legal access to zero percent THC products in this state. This bill redefined cannabidiol (CBD) and hemp-derived products to match federal law.  

The state allows the cultivation and commerce of hemp (and hemp products) and has maintained a restricted medical marijuana program since 2015. It allows qualifying patients to access CBD-rich cannabis oil with up to 5% THC. 

The program was expanded in 2019 when Gov. Brian Kemp signed HB 324, known as the Georgia’s Hope Act. This Act granted authority to the Department of Public Health to license and regulate the production and sale of low-THC oil for eligible patients. 

The bill addressed the production and regulations around purchase or transport of low-THC oil. It allows private companies and universities to grow and manufacture low-THC cannabis oil while recreational marijuana remains illegal.

What is Hemp-Derived Delta 9 THC?

Delta 9 THC, also known as traditional THC, is the primary psychotropic cannabinoid in cannabis. It’s prevalent in marijuana, the intoxicating cannabis variety that’s associated with the intoxicating sensation. 

The hemp plant does contain THC, but within the legal threshold set by federal law less than 0.3%.  Legal delta 9 THC is extracted from the buds and flowers of hemp with less than 0.3% THC

There’s no difference in chemical structure between hemp-derived and marijuana-derived THC. It’s the same molecule that, aside from being psychotropic, has medicinal benefits and can help with pain, inflammation, insomnia, poor appetite, nausea and vomiting, etc. 

Legal Delta 9 THC and Federal Law

Is delta 9 THC derived from hemp legal federally? 

Yes. The 2018 Farm Bill legalized the manufacture, distribution, and sale of hemp-derived products with less than 0.3% delta 9 THC. 

Before this bill, federal law didn’t differentiate between hemp and marijuana and classified both under the Marijuana Tax Act. The Farm Bill of 2018 removed hemp from the definition of marijuana and the list of controlled substances. The hemp plant is defined as: 

“The term ‘hemp’ means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis [2].”

Not only that, but the bill also removed ‘THC in hemp’ from the Controlled Substances Act. So, hemp is the legal Cannabis sativa, while marijuana continues to be an illegal drug. The primary way of differentiating hemp and marijuana is by the concentration of delta 9 THC in them. 

The new, legal delta 9 gummies are infused with whole-plant hemp extract with 10mg of delta 9 per gummy. Yet, they are 100% legal federally because the concentration of delta 9 in them is still under 0.3%. 

These gummies are mildly stimulating and cause a “high,” but they are still legal because they don’t exceed the concentration of 0.3 percent delta 9 by dry weight. 

A more complicated thing about this product is that they contain cannabidiol (CBD), which hasn’t been approved by the Food and Drug Administration (FDA). The FDA tolerates the use of CBD in food as long as the product is not sold as a dietary supplement under medical claims.
