Is Delta 8 THC Legal in Wyoming?

Yes, hemp-derived delta 8 THC is legal in Wyoming. 

Wyoming hasn’t explicitly banned the distribution and sale of hemp-derived delta 8 THC products. After the Hemp Farming Act was enacted, Wyoming updated its hemp laws to legalize hemp and hemp products, including cannabidiol (CBD).

HB 171 legalized the sale of the hemp plant and its derivatives, extracts, cannabinoids, isomers, acids, salts or salts of isomers with a THC concentration of less than 0.3%. You need to be 18 or older to purchase vaping and edible THC products under HB 108

After the 2018 Farm Bill was enacted, the state updated its Controlled Substances Act. In it, they exclude the possession of hemp and hemp products from scheduling. They state that the provisions and penalties included in the “control of substances” chapter don’t apply to “the possession or use of hemp or hemp products for any purpose or application.” 

This means that hemp-derived delta 8 THC is not a Controlled Substance in Wyoming. There’s a draft bill proposed in September 2023 that could add delta 8 THC to Schedule I, so things may change quickly for this cannabinoid.

What is Delta 8 THC?

In August 2020, the Drug Enforcement Administration (DEA) released an Interim Rule addressing the implementation of the Hemp Farming Act. In it, they stated that the Hemp Farming Act doesn’t impact the control status of synthetically derived tetrahydrocannabinol because the statutory definition of ‘hemp’ is limited to materials that are derived from Cannabis sativa L.”

As you can imagine, this statement brought a mountain of questions and general confusion about the legal status of D8 THC. The main source of confusion is the very origin of this cannabinoid because most products on the market are infused with D8 THC converted from hemp-derived cannabidiol (CBD) in a lab. 

Federal law doesn’t explicitly define the term “synthetic,” which leaves space for debate whether CBD-derived delta 8 is a “synthetic THC.” Most experts agree that this compound doesn’t quite fit the description of typical synthetic THCs like Spice and K2. Not only are they dangerous and potentially life-threatening, but they are made in a lab with no involvement of hemp material whatsoever. 

Delta 8, on the other hand, is made from an organically extracted source hemp-derived CBD. It’s important to note that this loophole gives the DEA space to consider hemp-derived D8 a synthetic cannabinoid. Given the DEA’s hostility towards cannabis, it’s very likely that they will keep the same stance in the Final Rule. But for now, the legality of D8 THC on a federal level remains in limbo.
