Is Delta 8 THC Legal in Oregon? 

Unfortunately, hemp-derived delta 8 THC that’s artificially derived from CBD is illegal in Oregon.

Under HB 3000, any “artificially derived cannabinoid” or a chemical compound created through a chemical reaction from a cannabinoid or other cannabis components is not legal to manufacture, distribute, sell, and buy in this state.

This means that delta 8 derived from hemp CBD found in most products on the market, is illegal in this state. HB 3000 also bans other cannabinoids derived from chemical compounds, including delta 10, HHC, and CBN.

When derived from the hemp plant, delta 8 THC is legal federally and under state laws.

Unfortunately, this cannabinoid is present in minuscule concentrations in the hemp plant and its extraction is time-consuming and financially taxing.

What Is Delta 8 THC?

This process creates a potential conflict with a regulation of the Drug Enforcement Agency (DEA) because when isomerized, D8 may be considered a synthetically-derived tetrahydrocannabinol. Namely, DEA’s Interim Rule groups all synthetically derived tetrahydrocannabinol, a Schedule I controlled substance.

The ongoing debate is whether Delta-8 THC made using the method of isomerization (conversion of one cannabinoid into another) is considered a “synthetic” drug.
