From a legal perspective, D8 made from hemp-derived CBD is in a grey area. Why? Some experts suggest that because it’s converted from CBD, the feds might consider it “synthetically derived.” Federal law bans any type of “synthetically derived tetrahydrocannabinols” because they are made from non-organic compounds and cause potentially lethal effects. 

The question here is whether D8 made from CBD falls under this category. And that’s a difficult one because federal law doesn’t explicitly define the term “synthetically derived tetrahydrocannabinols.” 

This issue alone leaves space for the feds to label D8 as “synthetic” when she’s NOT. If we were to disregard the conversion process D8 goes through, this cannabinoid is still made from naturally extracted hemp cannabinoids. The same cannot be said for “synthetic THCs.”
