Is Delta 8 THC Legal in Ohio?

What is Delta 8 THC? 

It’s a minor hemp cannabinoid present in the plant in minuscule amounts (less than 0.1%). Natural extraction of D-8 is not financially viable due to its concentration in the plant. So, chemists convert hemp-derived cannabidiol (CBD) into D-8 via isomerization.  

As a “twin”molecule to classic THC or delta 9, this compound will still get you intoxicated or “high,” but to a lesser extent. According to research, D-8 is around half the potency of D-9 if consumed at the same dose. The legality of delta 8 on a federal level is confusing.

But unlike other hemp cannabinoids that are directly extracted from the hemp plant, D8 THC is made by converting hemp-derived cannabidiol (CBD). This process of chemically converting one compound into another is called isomerization and may put D-8 in the category of “synthetically derived tetrahydrocannabinols.”

Federal law bans synthetic THC, and for a good reason: they are dangerous, lab-made chemicals that have nothing in common with the cannabis plant. Synthetic THC like Spice and K2, mimic the effects of real delta 9 THC, but exhibit more intense, unpredictable, and, in some cases, life-threatening effects.

But, because the law doesn’t explicitly define “synthetically derived tetrahydrocannabinols,” there’s a possibility that D-8 made from CBD can be considered one.

Most experts agree that D8 THC is not a naturally extracted hemp cannabinoid, but it’s also far from being a synthetic one. The difference between D-8 derived from CBD and “synthetic THC” is in that the latter ones are created in a lab from non-organic sources. 

According to a document by the National Institute on Drug Abuse, “synthetic cannabinoids refer to a growing number of man-made mind-altering chemicals that are either sprayed on dried, shredded plant material and can be smoked (herbal incense) or sold as liquids to be vaporized and inhaled in e-cigarettes and other devices (liquid incense).”

This definition does not encompass or describe delta 8 converted from hemp CBD. Because the 2018 Farm Bill legalized hemp and all its derivatives, delta 8 THC is currently in a legal grey area.
