Shortly after the 2018 Farm Bill passage, Missouri updated its hemp laws to match federal law. The state legalized the hemp plant with less than 0.3% THC and all extracts, isomers, cannabinoids, salts, and salts of isomers. The Show-Me State amended its Controlled Substances Act to exclude hemp from its list of controlled substances. 

The updated version of the law clarifies the difference between hemp and marijuana and excludes tetrahydrocannabinols from hemp from the list of Schedule I substances. This means that hemp-derived Delta-8 THC is legal in Missouri. 

Legal hemp products can be sold in Missouri without major restrictions, which explains the wide availability of D8 in the state. There is no age restriction on who can purchase D8, but due to the nature of this cannabinoid, many retailers sell it to adults of at least 21 years of age.    

Delta-8 THC and Federal Law 

Delta-8’s legality on a federal level is in limbo.

In 2020, the Drug Enforcement Administration (DEA) issued a Rule that addressed the legality of “synthetically derived tetrahydrocannabinols.” This Rule could impact the hemp industry because it may place Delta-8 THC in “synthetic” THC. 

The Rule states that “for synthetically derived tetrahydrocannabinols, the concentration of Delta-9 THC is not a determining factor whether the material is a controlled substance. All synthetically derived tetrahydrocannabinols remain schedule I controlled substances.”

As you probably know, Delta-8 which is currently available on the market, is chemically converted from hemp-derived cannabidiol (CBD) via isomerization. This means that it’s not naturally extracted from the hemp plant in its organic state. D8 occurs in the hemp plant in tiny amounts (less than 0.1%), so this chemical conversion allows manufacturers to produce D8 in large quantities while keeping the process financially viable. 

The problem is that the term “synthetically derived tetrahydrocannabinols” is not expressly defined in the Rule nor the federal Controlled Substances Act. In a 2017 Resource Guide, the DEA explains that synthetic cannabinoids are chemical compounds created in a laboratory, instead of organically extracted from plants. 

To give context, “synthetic THC” got banned because of the rise of entirely man-made THCs, like Spice and K2. These synthetic tetrahydrocannabinols mimic the effects of cannabis THC but are purely made from chemicals without using cannabis plant material. 

But, the fact that Delta-8 THC is produced through a chemical reaction that converts hemp-derived CBD makes it a potential candidate for a federal ban. This disregards the legalization of hemp derivatives like D8 in the 2018 Farm Bill, which are defined as “a substance that can be made from another substance.” 

When speaking about the Farm Bill, it’s important to note that the main idea behind it was to legalize hemp as a non-intoxicating plant. Delta-8 is a hemp derivative, but because it’s an intoxicating compound, it requires different regulatory measures.
