Unfortunately, hemp-derived delta 8 THC is not legal in Mississippi.

Under state law (HB 1547), delta 8 is considered a prohibited substance. The Magnolia State has explicitly banned delta 8 THC. Mississippi amended its Controlled Substances Act to exclude hemp and all hemp products, but it didn’t make an exception for hemp-derived THC, including delta 8 THC. 

Mississippi considers all isomers, synthetic substances, and derivatives of tetrahydrocannabinols illegal. The only exceptions to this rule are synthetic cannabinoid medications dronabinol and nabilone (and hemp).

What is Delta 8 THC? 

Delta 8 THC is a minor hemp cannabinoid found in the hemp plant in minuscule amounts (less than 0.1%). Because D8 is present in tiny quantities in the hemp plant, manufacturers make it by converting hemp-derived CBD. 

Early research shows that D8 can cause an intoxication similar to delta 9 THC, the primary intoxicating component of cannabis. But, D8’s “high” is to a much lesser extent because the compound is roughly half as potent as D9 at the same dose. D8 causes a different type of feel, a more “mild” intoxication that allows the user to stay productive instead of couch-locked and paranoid.      

Delta 8 THC and Federal Law 

Unfortunately, things have stalled regarding the federal legality of delta 8 THC. 

We’re still dealing with the status quo as experts continue to debate its legality. The main question is whether delta 8 made from hemp CBD is considered a “synthetically derived tetrahydrocannabinol.”

Delta 8 is present in the hemp plant in minimal amounts (less than 0.1%), which is insufficient for it to be extracted organically. So, manufacturers use hemp-derived CBD to create D8 via isomerization the process of converting one chemical compound into another. Made this way, D8 may be considered a “synthetic” cannabinoid by the Drug Enforcement Administration (DEA). 

In 2020, the DEA issued a report that stated, “all synthetically derived tetrahydrocannabinols remain Schedule I substances.” The issue here is that the report doesn’t define the term “synthetically derived tetrahydrocannabinols,” so the confusion remains as experts are unsure whether D8 should be considered “synthetic.” 

Why? Because D8 is converted from hemp-derived CBD, which doesn’t quite make it a “synthetic” compound. While it’s not entirely organic, D8 made from CBD is not entirely “synthetic” either. In general, “synthetic THCs” are chemicals entirely made in a lab without any involvement of cannabis plant material. These compounds have nothing in common with real THC but mimic THC’s effects in the body.  

And if it is considered “synthetic,” many experts argue that hemp-derived D8 still falls under the 2018 Farm Bill and is entirely legal. The only pushback against this argument is delta 8’s intoxicating nature, which doesn’t quite fit with the idea of hemp as a 100% non-intoxicating, legal plant.
