Is It Legal: Wyoming Delta-10 THC Laws

The short and simple answer is: YES! Delta-10 THC is LEGAL in Wyoming.

What Is Delta-10 THC?

Delta-10 tetrahydrocannabinol (D-10 THC) is another THC isomer with intoxicating properties. This compound is present in the hemp plant in trace amounts and has the power to get you “high.” To create large quantities of D-10 THC, chemists alter the Delta-9 THC or cannabidiol (CBD) molecule with the help of catalysts.

Users describe Delta-10 THC’s effects as an improved version of Cannabis sativa strains — they are way milder and don’t cause the typical anxiety, depression, paranoia, or hallucinations triggered by traditional THC. Anecdotal evidence shows that D-10 THC is uplifting, energizing, and boosts creativity and sharpness of mind.

Continued, Is Delta-10 THC Legal in Wyoming?

YES. Hemp-derived Delta-10 THC is LEGAL in Wyoming.

Wyoming hasn’t explicitly banned or prohibited the production, distribution, and sale of hemp-derived Delta-10 THC products. This means that the cannabinoid remains unregulated in this state, but you can buy it without any restrictions. Delta-10 can get you high, so most shops that offer it sell it only to users 21 and older.

The Equality State has yet to introduce legislation regarding hemp tetrahydrocannabinols like Delta-10. Wyoming swiftly updated its hemp laws to accommodate the provisions of the Farm Bill of 2018. The state legalized the hemp plant and its derivatives, extracts, cannabinoids, isomers, acids, salts or salts of isomers with a Delta-9 THC concentration of less than 0.3 percent.

The Equality State also updated its Controlled Substances Act to add that the provisions and penalties of the Controlled Substances list don’t apply to “hemp or hemp products for any purpose of application.”

It’s important to mention that Wyoming has some of the strictest marijuana laws in the nation. Cannabis is strictly illegal and not allowed for medical purposes. The state is in the process of legalizing medical marijuana, but it has yet to establish a comprehensive program.

Delta-10 THC and Federal Law

The DEA’s list of controlled substances lists “tetrahydrocannabinols” as illegal. So, how come an intoxicating tetrahydrocannabinol like Delta-10 THC is legal to buy and sell?

It’s important to note that the legality of D-10 THC on a federal level is murky and complicated. But, it all comes down to one thing: If derived from hemp (instead of marijuana), D-10 THC is considered legal.

The Agriculture Improvement Act of 2018 (also known as the “Farm Bill”) legalized the hemp plant and removed “tetrahydrocannabinols in hemp” from the DEA’s list of controlled substances. This means that all hemp THCs (except for Delta-9 THC) are legal under federal law. But, there’s a catch.

The Farm Bill of 2018 didn’t impact the status of “synthetically derived tetrahydrocannabinols.” This was confirmed in the DEA’s Interim Rule of 2020, which stated: “all synthetically derived tetrahydrocannabinols remain Schedule I controlled substances.”

Because D-10 and D-8 THC are present in the hemp plant in a tiny concentration, their natural extraction can be a waste of time and plant resources. So, to obtain D-10 THC in large quantities, manufacturers take hemp-derived cannabidiol (CBD) and alter it by using chemical synthesis.

Processors use many chemicals and steps to create D-10 THC from CBD or Delta-9 THC. Due to heavy processing, D-10 THC is considered a semi-synthetic cannabinoid. Does this make it an illegal substance? That’s up for debate.

Most experts agree that as long as the compound is derived from hemp, it’s protected under the 2018 Farm Bill. The U.S. Cannabis Council stated that there’s no Farm Bill loophole because the Act does not legalize the reproduction of psychoactive drugs because the base material comes from hemp.

The DEA hasn’t explicitly defined the term “synthetic” in its Interim Rule, which adds to the confusion. Another issue is the dissimilarity between THC compounds like D-10 THC which naturally exist in the hemp plant and truly “synthetic THC” like Spice and K2.

These chemical compounds are created in a laboratory to mimic the effects of cannabinoids and can cause serious side effects. That said, the industry is waiting for the DEA’s to clear the air around the legality of hemp THCs.

Bottom line
