After the passage of the 2018 Agricultural Improvement Act, South Dakota updated their hemp legislation — legalizing hemp and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, with a Delta-9 THC concentration of less than 0.3 percent.

The state has specifically removed hemp from the definition of marijuana, which is considered a controlled substance in South Dakota. Therefore, if made from hemp, D-10 is not a controlled substance in the state. 

South Dakota has yet to introduce legislation that would regulate hemp-derived tetrahydrocannabinols. The state is one of the latest to legalize medical marijuana. From July 1, 2021, residents with qualifying medical conditions can possess 3 ounces or less of legal cannabis. 

Delta-10 THC and Federal Law 

Hemp tetrahydrocannabinols like Delta-8 and Delta-10 THC are in a legal gray area federally, thanks to a loophole in the 2018 Farm Bill. The Agricultural Improvement Act of 2018 specifically excluded “hemp tetrahydrocannabinols” from the list of controlled substances on a federal level.

Because D-10 is made using chemical synthesis, and hence, considered semi-synthetic, it may easily fall under the group of “synthetic” tetrahydrocannabinols. Federal law does not explicitly define the term “synthetic,” which creates confusion around the legal status of this cannabinoid. 

In its Interim Final Rule issued late August 2020, the Drug Enforcement Administration (DEA) stated: “all synthetically derived tetrahydrocannabinols remain Schedule I controlled substances.” The hemp industry awaits the release of the Final Rule by the DEA. The Rule will either regulate or ban the manufacture, distribution, and sale of this compound. 

One of the main arguments against the legality of this compound is that it’s intoxicating. According to the US Cannabis Council, the 2018 Act doesn’t legalize the production of psychoactive drugs because they’ve been derived from hemp. The hemp plant and all hemp-derived cannabinoids have been legalized because they are non-intoxicating. While this argument holds true, it’s important to notice the discrepancy between the law and the chemical nature of the cannabis plant.
