Rhode Island expressly banned the manufacture and sale of tetrahydrocannabinol and its isomers. 

Rhode Island classifies all tetrahydrocannabinols (whether derived from hemp or marijuana) and its isomers as Schedule I controlled substances. The state’s “Uniform Controlled Substances Act” exempts certain forms of hemp from scheduling, but in general, prohibits the sale of any product that delivers tetrahydrocannabinol to the body. 

After the 2018 Agricultural Improvement Act, Rhode Island legalized the hemp plant and cannabidiol (CBD). But, the state prohibited the manufacture and sale of any product that contains any THC amount and is intended for human or animal consumption including Delta-9 THC and isomers like Delta-8 and Delta-10 THC. 

Cannabidiol (CBD) products with less than 0.3% THC made from hemp material containing less than 0.3% THC are legal in the Ocean State. You can freely buy CBD oil and other products meant for consumption if you live in Rhode Island. 

Delta-10 THC and Federal Law 

One of the main reasons some states in the nation decided to ban Delta-8 and Delta-10 THC is that they are intoxicating. But, what about their legal status on a federal level? Is Delta-10 THC legal under federal law? Shortly put, the situation is complicated.

Delta-10 THC occurs in the cannabis plant in very minimal concentrations even lower than Delta-8 THC. So, companies create larger quantities by using hemp-derived cannabidiol (CBD) and converting it into this substance through chemical synthesis. 

This means that compared to Delta-8 THC made through regular conversion (isomerization) of one molecule into another, D-10 THC is more heavily processed. As such, it could be easily deemed a “synthetically derived tetrahydrocannabinol” by the Drug Enforcement Administration (DEA). 

Namely, the DEA issued an Interim Final Rule on hemp, which confirmed the illegal status of “synthetic THC,” without providing a definition of which compounds are considered synthetic under federal law. The lack of clear provisions regarding the legality of these new hemp cannabinoids and the methods used to create them caused confusion in the industry. 

As a result, the sale of D-10 THC and similar hemp THC isomers is possible because these compounds are derived from hemp. The Agricultural Improvement Act (Farm Bill) of 2018 legalized the hemp plant and all its derivatives and cannabinoids as non-intoxicating compounds. 

The issue here is that hemp-THC compounds act more like marijuana than hemp. Due to that reason, the U.S. Cannabis Council stated that the Farm Bill “does not legalize the production of psychoactive drugs simply because the base material has been extracted from industrial hemp.” That said, the legality of these compounds remains unclear until the DEA’s final report provides clarification.
