The Keystone State explicitly excludes industrial hemp and any part of the plant containing a Delta-9 THC concentration of less than 0.3 percent — from the list of Controlled Substances. This means that hemp THCs like Delta-8 and Delta-10 are legal in Pennsylvania if derived from hemp and contain less than 0.3% Delta-9 THC. Another thing to consider regarding the legality of Delta-10 THC is the legalization of hemp under the Agriculture Improvement Act of 2018. The Act excluded “tetrahydrocannabinols in hemp” from the federal list of controlled substances. Still, the U.S. Cannabis Council stated that the Act does not legalize psychotropic compounds and their products simply because they are made from hemp-derived material.  

In conclusion, the legality of D-10 THC on a federal level is murky until the release of the DEA’s Final Rule that’s expected to bring clarification on the issue.
