Is It Legal: Ohio Delta-10 THC Laws

The short and simple answer is: YES! Delta-10 THC is LEGAL in Ohio.

What Is Delta-10 THC?

Delta-10 tetrahydrocannabinol (D-10 THC) is a minor hemp cannabinoid that produces a mild, uplifting buzz even milder than Delta-8 THC. This substance heightens focus, creativity, and energy, which are effects attributed to sativa cannabis strains. Compared to D-10 THC, Delta-8 THC leans more towards indica cannabis strains and promotes deep relaxation and even sleep.

Like D-8 THC and D-9 THC, this substance interacts with the endocannabinoid system (ECS), which is integral in maintaining homeostasis the internal balance between the brain and the body. But, scientists are unsure of its binding mechanisms and the extent of its effects.

The only information we have is from a 1980s pigeon study performed by the popular cannabis scientist Raphael Mechoulam. The study revealed that Delta-10 THC’s psychotropic properties are way milder than Delta-9’s

Continued, Is Delta-10 THC Legal in Ohio?

Ohio hasn’t expressly banned the manufacture and sale of hemp-derived Delta-10 THC products.

After the 2018 Agricultural Improvement Act, Ohio legalized hemp and all hemp derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers with a Delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent.

The Buckeye State amended the definition of “tetrahydrocannabinols” under the Controlled Substances Act and excluded “tetrahydrocannabinols found in hemp” and “hemp products” from the definition of THC.

Ohio has yet to introduce legislation that would regulate hemp-derived tetrahydrocannabinols. The state enacted a set of regulations on Delta-8 THC (and other THC isomers like Delta-10 THC) within its medical marijuana program, but they don’t have a direct impact on the sales outside Ohio’s Medical Marijuana Control Program.

Changes Regarding Medical Cannabis Products

The state recently made changes to its medical marijuana program regarding the sale of Delta-8 THC and other THC isomers. On June 15, the Ohio Department of Commerce released a set of regulations on Delta-8 THC in medical marijuana products.

Before these regulations, producers and testing labs didn’t have to state the Delta-8 THC content on the label. The new guidance declares that manufacturers and testing labs must list the exact amount of Delta-8 THC on the product label.

The state also capped the levels of the THC content in medical cannabis products to 70 percent. The total THC content includes Delta-9 THC and any other THC isomers, including Delta-8 and Delta-10.

Delta-10 THC and Federal Law

As an intoxicating hemp-derived tetrahydrocannabinol, Delta-10’s legality on federal and state levels is gray. This cannabinoid is a real THC isomer that belongs to the minor group of compounds present in the plant that scientists could barely trace and recognize.

Therefore, this substance can be obtained in large quantities only if created in a lab. Scientists use chemical synthesis and catalysts to convert hemp CBD into Delta-9 and then into Delta-10 THC. Because this substance is so heavily processed, it’s considered semi-synthetic.

The 2020 Interim Final Rule by the Drug Enforcement Administration (DEA) stated that “all synthetically derived tetrahydrocannabinols remain Schedule I controlled substances,” regardless of the levels of Delta-9 THC contained in a product infused with synthetic cannabinoids.

Namely, the Agricultural Act (Farm Bill) legalized all hemp-derived cannabinoids with the primary idea of the hemp plant as non-intoxicating. As a result, D-10 THC could be considered an illegal substance, not only because it’s made using chemical synthesis but also because it’s intoxicating. The debate is ongoing until the release of the Final Rule by the DEA that’s promised to bring clarification.

Ohio hasn’t expressly banned the manufacture, distribution, and sale of hemp-derived Delta-10 THC. For now, this substance is legal to buy in the Buckeye State. The best place to find quality D-10 THC products is online in licensed hemp stores like Mr. Hemp Flower.
