Hemp-derived Delta-10 THC is in a GRAY legal area in New York. 

In late May, the New York State Health Department amended part of the legislation regulating the processing and retail sale of hemp cannabinoids in New York State. 

The revised regulations prohibit hemp processors from using synthetically derived cannabinoids like Delta-8 and Delta-10 THC “created through isomerization in the extraction or manufacturing of any cannabinoid hemp product.” 

The revised amendment also prohibits “the use of Delta-8 tetrahydrocannabinol created through isomerization in the processing of cannabinoid hemp products.”

It’s apparent that the new regulations are meant to clarify the state’s stance on hemp tetrahydrocannabinols, but many questions remain unanswered. Mainly because the language of the amendment is specifically related to the manufacturing process. Until the state enacts the ban and explicitly prohibits the sale of these compounds, their legality remains murky. 

Can you still buy products with Delta-10 THC in New York today? 

As of this writing (07/10/2021), you CAN buy Delta-10 THC products if you live in New York. The state has yet to adopt and enact the ban, which means that it’s not immediate. 

New York is also the 17th state to legalize adult-use marijuana. Adults 21 or older can possess up to three ounces of marijuana or 24g of high-THC concentrates. The state will start retail sales later in 2022. 

Delta-10 THC and Federal Law 

As semi-synthetic hemp-derived tetrahydrocannabinol, Delta-10 THC has a complicated relationship with the law. Some experts claim that as long as the compound comes from hemp versus marijuana it is legal under federal law because it falls under the 2018 Farm Bill. Others take a stricter approach and consider it fully illegal.  

The Drug Enforcement Administration (“DEA”) stated in its Interim Rule (released late August 2020) that “all synthetically derived tetrahydrocannabinols are considered Schedule I controlled substances.” 

The DEA is currently working on the rulemaking process regarding the implementation of the 2018 Farm Bill, including the scope of regulations over marijuana, THCs, and other related constituents. Until the Final Rule comes out, the legality of these cannabinoids remains unclear or in the legal gray area. 

So, is Delta-10 THC synthetic THC? We’d say it depends on the viewpoint. Compared to truly artificial tetrahydrocannabinols, like Spice and K2, Delta-10 doesn’t quite fit in the category of “synthetic.” 

First, synthetic THCs are dangerous. They greatly intensify the effects of Delta-9 THC to the point of becoming a danger to one’s life. Second, synthetic THCs have nothing to do with the cannabis plant. They are made in a lab without any involvement of cannabis plant material or compounds.

Delta-10 THC is also created in a lab by converting hemp-derived cannabidiol (CBD) first into Delta-9 THC and then into Delta-10. Chemists may use different processes to make this compound, some of which involve toxic and dangerous chemicals. Again, here comes the importance of purchasing tested D-10 products from a reliable manufacturer. 

Because D-10 is more heavily processed, it’s considered a semi-synthetic cannabinoid. But, because it comes from hemp compounds, it exists in a gray (the grayest possible) legal area.
