The rule stated that for “synthetically derived tetrahydrocannabinols” the concentration of Delta-9 THC is not a determining factor in the legality of the material. The rule doesn’t expressly define “synthetically derived THC,” and in a 2017 Resource Guide, the DEA states that “synthetic cannabinoids are not organic, but are chemical compounds created in a laboratory.” 

Although the rule doesn’t clearly define the term “synthetic,” there is a high probability that it would deem hemp THCs like Delta-8 and Delta-10 illegal federally. That is, with a complete disregard of the 2018 Farm Bill, which legalized hemp and hemp derivatives, aka substances made from another substance. 

It’s clear that the situation regarding the legality of Delta-10 is very complicated, mainly because the Farm Bill doesn’t support the Interim Rule. To make things even more complex, D-10 THC is an intoxicating cannabinoid, and it’s clear that the Farm Bill didn’t intend to legalize intoxicating cannabinoids, hence the 0.3% Delta-9 THC limit on hemp material and finished products. 

That said, the situation is expected to be cleared with the release of the Final Rule. Until then, D-10 remains in a gray legal area.
