Mississippi’s law explicitly prohibits the sale and distribution of Delta-10 THC.

The Magnolia State considers all isomers and derivatives of tetrahydrocannabinol and synthetic equivalents of substances contained in cannabis illegal. The only exceptions are synthetic cannabinoids, dronabinol, and nabilone used as a medication for nausea and vomiting caused by chemotherapy.  

Delta-8 THC and its isomers (Delta-10 is a THC isomer) are strictly banned in the Magnolia State. 

The state’s hemp law clearly distinguishes hemp from the definition of marijuana and removes the plant from its Controlled Substances Act. Under Mississippi law, tetrahydrocannabinols exclude hemp or hemp products. But, the type of products and substances available for sale and distribution is also limited. If the product looks like marijuana, Mississippi police are likely to arrest the person possessing it. 

The state doesn’t treat all cannabinoids the same, so cannabidiol (CBD) with low THC levels (0.3 percent or less) is a safe substance to purchase. The state also provides an exception for extracts and oils with a 20:1 ratio of CBD:THC if diluted to 2.5mg of THC per milliliter.   

After the 2018 Farm Bill, the state enacted new hemp legislation that legalizes the hemp plant and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers with a Delta-9 THC concentration of not more than 0.3 percent. So hemp and all CBD products with less than 0.3% THC are legal in the Magnolia State.

Delta-10 THC and Federal Law 

The law isn’t exactly clear about the legal status of hemp-derived tetrahydrocannabinols like Delta-8 and Delta-10 THC. This situation is unlike any other, which places D-10 THC in the grayest legal area of hemp laws on state and federal level.

D-10’s legal complexity is greater than D-8’s because of the differences in manufacturing. Under the 2018 Farm Bill, hemp and all hemp-derived cannabinoids, extracts, derivatives, isomers, and material with less than 0.3% Delta-9 THC are legal federally. So, technically, what keeps D-10 THC in the gray legal zone is the fact that it’s made from hemp-CBD. 

Because this compound undergoes heavy processing, it could be considered “synthetically derived” by the Drug Enforcement Administration (DEA). Technically, Delta-10 THC is a semi-synthetic compound derived from natural sources, aka hemp-CBD.

That said, the 2020 Interim Rule touched on the subject of “synthetically derived tetrahydrocannabinols” and confirmed that they are illegal under federal law. Despite being made using artificial methods, D-10 THC is far from acting like “synthetic THC.” Synthetic THC is entirely artificial, created from non-organic compounds. They are also dangerous and, if misused, can lead to addiction and overdose. 

The industry expects further clarification on this topic in the Final Rule. As of this writing, the DEA is undergoing the rulemaking process concerning the implementation of the 2018 Farm Bill. Therefore, this substance remains in a legal gray area federally. 

Bottom line

Mississippi explicitly prohibits the distribution and sale of hemp-derived Delta-8 and, very likely, Delta-10 THC. As of this writing, this substance is NOT legal to buy in the Magnolia State.
