Michigan legalized the distribution and sale of hemp-derived Delta-10 THC.

After a bunch of states banned hemp-derived Delta-8 and Delta-10 THC, Michigan took a different route. Instead of going for prohibition, the Great Lake State regulated the distribution and sale of these intoxicating hemp cannabinoids.

On July 13, 2021, Governor Gretchen Whitmer signed multiple cannabis-related bills, including the one that would regulate Delta-8 THC. One of the bills categorizes all THC isomers of the cannabis plant (Delta-9, Delta-8, and Delta-10) as marijuana. As such, these products will now be regulated under the state’s Marijuana Regulatory Agency. 

The good news is, Delta-10 THC and other intoxicating cannabinoids will be fully regulated, tested, and produced by licensed vendors. The bad news is that prices are likely to go up, and there’s going to be a limit on the percentage of THC a product can contain. 

The new law takes effect on October 11, 2021, and requires all intoxicating substances to be tested for safety under the state’s monitoring system. So, in less than three months, unlicensed stores will have to stop stocking D-8 and D-10 cannabis products. 

Delta-10 THC and Federal Law 

Delta-10 THC exists in a legal gray area federally, thanks to a loophole in the 2018 Farm  Bill. Namely, the bill legalized hemp and hemp derivatives, cannabinoids, and extracts with less than 0.3% THC. Because it’s made from hemp, D-10 THC is technically considered hemp-derived and falls under the protection of the 2018 Farm Bill.

The issue with D-10 THC and similar compounds is that they are intoxicating. The main reason behind legalizing hemp with less than 0.3% THC was to reap the benefits of non-intoxicating cannabis varieties. Therefore, D-10 THC goes against the grain because it’s intoxicating and is not naturally extracted directly from the hemp plant. 

Because there are no hemp strains with high D-10 THC levels, chemists create the compound in a lab using hemp-derived cannabidiol (CBD). As a heavily processed substance, D-10 THC can be easily considered a synthetic cannabinoid by the feds. 

In fact, the Interim Rule released by the Drug Enforcement Agency in 2020 confirmed that synthetically derived tetrahydrocannabinols are considered illegal. The confusion regarding the legality of these compounds stems from a lack of clarification of terms like “synthetic.” What does the term encompass? Is D-10 THC considered fully synthetic and dangerous? And so on. 

The DEA is currently undergoing the rulemaking process regarding the implementation of the Hemp Farming Act and will reveal the scope of regulations on D-10 THC in the Final Rule.
