Because of this, D-10 could very easily be considered a controlled substance, despite being derived from the hemp plant. 

In 2020, the U.S. Drug Enforcement Administration (“DEA”) released its Interim Rule that confirmed the illegal status of all “synthetically derived tetrahydrocannabinols.” The report doesn’t answer all of the issues related to the legality of these compounds. The industry expects clarification in the Final Rule, so, until release, D-10 THC remains in a legal gray area.
