Unfortunately, hemp-derived Delta-10 THC is NOT legal in Iowa. 

Iowa has some of the strictest hemp CBD laws in the nation. While hemp-derived cannabidiol (CBD) is legal in the state, the regulations require that patients register for an mCBD card to buy CBD products only from registered dispensaries. 

This means that CBD oil is not legal for purchase except for patients who qualify for Iowa’s medical marijuana program. Iowans can find CBD products in five state-licensed dispensaries across the country. 

Unless a cannabinoid is approved for medical purposes, it’s illegal in Iowa. For now, the state’s law lists all tetrahydrocannabinols, synthetic equivalents, derivatives, and isomers with a similar chemical structure and pharmacological activity as controlled substances. Meaning, Delta-10 THC is currently illegal in the Hawkeye State.  

Delta-10 THC and Federal Law 

The Agriculture Improvement Act of 2018, aka the “Farm Bill,” legalized the hemp plant and allowed businesses and consumers to get a taste of the benefits of this plant. The Act also removed “tetrahydrocannabinols in hemp” from the federal list of controlled substances — making all hemp THCs (including naturally occurring Delta-8 and Delta-10) legal under federal law.  

The Act didn’t change the federal status of “synthetic tetrahydrocannabinols” which remain illegal. The DEA’s Interim Rule released late August 2020 confirmed this fact but didn’t define the term “synthetic.” Most experts agree that D-10 THC is heavily processed and considered semi-synthetic but isn’t the equivalent of truly synthetic substances like Spice and K2. 

Is Delta-10 THC a synthetic substance? That’s up for debate. As of this writing, we don’t have an answer, but there’s a high probability that this cannabinoid will be, first and foremost, deemed marijuana-like because it’s psychotropic and causes a high. Until that happens, it exists in a legal gray area that allows businesses to sell it in states with no restrictions and bans.

As of this writing, Delta-10 THC is NOT legal to buy in the Hawkeye State. Iowa considers nearly every derivative of marijuana illegal and allows the sale of CBD products only with a medical marijuana card. If you live in Iowa, avoid ordering D-10 THC products.
