Continued, Is Delta-10 THC Legal in Idaho? 

Unfortunately, hemp-derived Delta-10 THC is NOT legal in Idaho. 

Idaho was the last US state to legalize hemp as a commodity crop. On April 16, 2021, Governor Brad Little signed House Bill 126 into law. The bill legalized the production, processing, research and transportation of hemp with less than 0.3% THC. Idaho Legislators tailored the hemp law very narrowly as it only focuses on growing industrial hemp. 

The sale and distribution of hemp CBD products with ANY levels of tetrahydrocannabinol is still prohibited in Idaho. 

The state has banned all tetrahydrocannabinols, their synthetic equivalents, derivatives, and their isomers with a similar chemical structure. They only make an exception for hemp plant material that can contain up to 0.3% Delta-9 THC or the federally allowed legal limit. This means that Delta-10 THC is illegal in the Gem State, which is not surprising considering the strict cannabis laws.

Delta-10 THC and Federal Law 

The legality of Delta-10 THC as an intoxicating cannabinoid on a federal level is complicated. One of the reasons why this compound may be considered legal is because of the Farm Bill loophole. On the other hand, the US Cannabis Council argues that the Farm Bill loophole doesn’t exist because the Act was not passed to legalize psychoactive drugs.

Namely, the Agriculture Improvement Act (aka Farm Bill) of 2018 legalized hemp and excluded “tetrahydrocannabinols in hemp” from the federal list of controlled substances. Therefore, tetrahydrocannabinols like Delta-8 and Delta-10, that naturally occur in the hemp plant in trace amounts are legal under federal law. But, because these compounds are present only in minuscule concentrations, their natural extraction is challenging and expensive. 

So, to create D-10 THC in larger quantities, scientists use hemp-derived CBD or Delta-9 THC. To get D-10 THC, labs use chemical synthesis, which makes this cannabinoid an artifact of cannabinoid production, aka a semi-synthetic molecule. 

Because the Farm Bill of 2018 doesn’t change the legal status of “synthetic tetrahydrocannabinols,” chances are, D-10 THC would be considered a controlled substance regulated under federal law. The current law doesn’t define the term “synthetic.” Providing clarity around the legal status of these compounds is essential because this cannabinoid is far from similar to truly synthetic THC substances like Spice. 

These synthetic substances are 100% artificial and, unlike Delta-10 THC, don’t naturally exist in the hemp plant. They mimic the effects of real THC but are dangerous and can cause serious side effects. 

We don’t have all the answers surrounding the legality of D-10 THC on a federal level. For now, D-10 THC remains in a legal gray area while facing the possibility of being regulated like a controlled substance.

Bottom line

As of this writing, Delta-10 THC is NOT legal to buy in the Gem State. Idaho has banned the use of any tetrahydrocannabinol in products. Idaho’s law even prohibits the use of hemp-derived CBD products containing any level of THC. If you live in this state, it’s safest to stay away from ordering Delta-10 THC products.
