As of this writing (07/15/2021), Hawaii law doesn’t explicitly prohibit the distribution and sale of Delta-10 THC. 

Hawaii doesn’t have a framework for the legal sale of Delta-10 tetrahydrocannabinol. The state updated legislation to fully legalize hemp and define it according to the federal definition. 

The Aloha State has stricter CBD laws than most and doesn’t allow the sale of CBD-infused foods, beverages, and cosmetics. Similar to California, the state of Hawaii follows federal guidelines when it comes to approval of these products by the Food and Drug Administration. 

The state’s bill makes a clear distinction between hemp and marijuana and exempts hemp-derived cannabinoids from their Controlled Substances Act. The legislators amended the section “tetrahydrocannabinols” to exclude “tetrahydrocannabinols in hemp.” This means that Delta-10 derived from hemp is not a controlled substance in Hawaii.  

Delta-10 THC and Federal Law 

Delta-10 THC and federal law have a complicated relationship. 

The law isn’t clear on where hemp-derived tetrahydrocannabinols, like Delta-10 and Delta-8 THC, belong. Primarily because of the way they are manufactured. While Delta-8 THC is directly converted from hemp-derived CBD using isomerization, Delta-10’s manufacturing process involves other chemical reactions. 

To create it, processors take hemp-CBD and convert it into Delta-9 THC because converting CBD into D-10 directly requires special conditions that not every lab has. Then, they convert Delta-9 THC into D-10 THC with the use of catalysts. Because D-10 is produced entirely by artificial creation, it’s semi-synthetic. 

The 2018 Farm Bill legalized the hemp plant and all hemp derivatives that contain less than 0.3% Delta-9 THC. Because D-10 technically comes from hemp-CBD, it could be considered a hemp derivative and fall under the Hemp Farming Act. That is unless the Drug Enforcement Administration (DEA) decides to ban hemp tetrahydrocannabinols altogether. 

In its Interim Rule, the DEA stated that “all synthetically derived tetrahydrocannabinols remain Schedule I controlled substances.”  But, the report doesn’t explicitly define the term “synthetic,” which makes things even more confusing. 

The DEA is currently working on the final rule regarding the implementation of the Agriculture Improvement Act of 2018. The rule will include the scope of regulatory controls over tetrahydrocannabinols. Until the process has been finished, the legality of hemp THCs remains murky on a federal level.
