Georgia law doesn’t explicitly prohibit the distribution and sale of hemp-derived Delta-10 THC. 

The state’s definition of hemp is identical to the definition adopted by federal law. Georgia legalized the hemp plant and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers with no more than 0.3% Delta-9 THC by dry weight.

Delta-10 THC is almost non-existent in the hemp plant. Unlike Delta-8, which can be found in trace amounts, this cannabinoid is formed in the early stages of development of the plant and cannot exist on its own. Because of this, chemists take hemp-CBD and convert it into Delta-9 THC, which is easier to convert into D-10 THC. 

Compared to D-8 THC, D-10 is more heavily processed, which makes it semi-synthetic. Federal law prohibits the manufacture and use of synthetic tetrahydrocannabinols, as confirmed by the Drug Enforcement Administration (DEA) in their Interim Rule. Federal law doesn’t explicitly define the term “synthetic,” so it’s unclear whether D-8 and D-10 are part of the category.

The difference between synthetic tetrahydrocannabinol and Delta-10 THC is evident. This cannabinoid comes from a natural source (hemp CBD), while synthetic THCs like Spice and K2 are entirely artificial substances. Also, synthetic THCs are dangerous and exacerbate the effects of Delta-9 THC to the point of becoming a threat to the user’s life.  

The DEA is currently working on the rulemaking process regarding the implementation of the 2018 Farm Bill. Until the agency reviews comments and finishes the process, the legality of D-10 THC on a federal level remains murky.
