This means that Delta-10 THC is a controlled substance in Delaware and cannot be produced, distributed, or sold in the state legally.

Delta-10 THC and Federal Law

However, the one thing that the Act didn’t change was the legality of synthetic tetrahydrocannabinols.   

This was confirmed in the DEA’s Interim Rule in 2020, which stated that regardless of the passage of the Act, “all synthetically derived tetrahydrocannabinols remain Schedule I controlled substances.” 

So, the main question is whether a natural THC molecule like D-10 THC that naturally occurs in the hemp plant is considered synthetic if synthesized from other cannabinoids? Most experts agree that D-10 THC cannot be placed in the same bracket as truly artificial (and dangerous) THCs like Spice. 

We don’t have the full answer surrounding the federal legality of this compound because the law doesn’t clearly define the term “synthetic” and which compounds fall within that category. So, for now, D-10 THC remains in a gray area with a complex legal status. And the possibility of being regulated as a marijuana-like controlled substance.
