Unfortunately, hemp-derived Delta-10 THC is NOT legal in Connecticut. 

Starting July 2021, Delta-8, Delta-10 and other cannabinoids can only be sold by licensed cannabis establishments in Connecticut. The state passed Senate Bill 1201 (An Act Concerning Responsible and Equitable Preservation of Adult Use Cannabis) into law in June 2021, which established an adult-use cannabis marketplace. 

Now that cannabis is legal for recreational purposes in the Nutmeg State, D-10 and other THCs derived from hemp are restricted only to licensed dispensaries. 

The Act defined cannabis to include hemp products with total THC concentration of more than 0.3 percent on a dry weight basis. The definition includes THC isomers like Delta-7, Delta-8, Delta-9, and Delta-10. 

Can you still buy products with Delta-10 THC in Connecticut today? 

According to the state’s official cannabis website, you can’t. All products that exceed 0.3% THC (regardless of the type) on a dry weight basis are considered cannabis. Such products can only be sold in the adult-use market by a licensed retailer. Sales of high-THC products are expected to begin in late 2022. 

For now, delta products with THC content greater than 0.3 percent are available only to medical marijuana patients. All products with a total THC or THC content of less than 0.3 percent are compliant with the law. 

Delta-10 THC and Federal Law 

The legality of Delta-10 THC on a federal and state level is up for debate. 

All hemp-derived cannabinoids are legal under the 2018 Farm Bill. If this compound is derived from hemp versus marijuana, it’s legal under federal law. 

But, things are more complicated than that. For one, D-10 THC (and Delta-8) is a mildly intoxicating cannabinoid. Meaning, it will get the user high. As we all know, the 2018 Farm Bill was enacted on the premise of hemp, CBD, and hemp cannabinoids being non-intoxicating compounds. 

Nonetheless, the natural progression of the hemp industry met demand on the market. Users wanted something more potent, so sales of these tetrahydrocannabinols didn’t fall flat. 

But, if we dive deeper into the processes used to make Delta-10 THC, its legality comes into question. According to the Interim Final Rule released in August 2020 by the Drug Enforcement Administration (FDA), all synthetically derived tetrahydrocannabinols are illegal substances. 

Judging by the methods used to create it, D-10 THC is semi-synthetic, hemp-derived tetrahydrocannabinol. It’s processed from hemp cannabidiol that’s being converted into Delta-9 THC and then Delta-10 THC. As a semi-synthetic, this cannabinoid doesn’t fall under the group of fully synthetic, dangerous THC, like Spice and K2. So, in terms of legality, D-10 stands in the grayest area of hemp laws that exist in the United States.

As of this writing, Delta-10 THC is NOT legal to buy in the Nutmeg State. Connecticut recently legalized recreational cannabis and restricted high-THC products to their cannabis program. Residents of this state should avoid ordering hemp-derived D-10 products until the law loosens up.
