As a state that pioneered medical cannabis and was one of the early adopters of recreational marijuana, the Golden State is among the worst in the nation when it comes to hemp-derived CBD laws.
So, you’re probably wondering where Delta-10 THC stands within the complex landscape of recreational, medical, and hemp laws in California? Is Delta-10 legal in the Golden State? If so, where to buy the best quality products?
Is It Legal: California Delta-10 THC Laws
The short and simple answer is
Delta-10 THC is LEGAL in California.
What Is Delta-10 THC?
Delta-10 tetrahydrocannabinol (D-10 THC) is an isomer of Delta-8 and Delta-9 THC. The term isomer describes molecules with the same chemical formula but a different arrangement of atoms. Another difference between these isomers (D-10, D-8, and D-9 THC) lies in their psychotropic properties.
Research is very scarce on Delta-10 THC’s beneficial properties and intoxicating effects. So, the only information we have on the compound comes from people who have tried it (including our team). Delta-10 is roughly half as potent as Delta-9 and better for promoting flow state, euphoria, and focus. So, yes, it does get you high.
Buy Delta-10 THC in California NOW
Buying hemp cannabinoid products like CBD or Delta-8 THC can be a bit complicated in California (more on that below). So, many wise people order their Delta-10 online.
If you already have experience buying CBD or Delta-8 products, you can apply that knowledge to buying D-10 THC. Like other goods containing cannabinoids, D-10 also has to be tested by a third-party, certified lab. Every established company on the market offers a Certificate of Analysis with each D-10 product, including Mr. Hemp Flower. If you come across items that come without a lab report, it’s best to be cautious and avoid buying.
Transparency is essential in the developing hemp industry. There are so many bad actors on the market that fake not only the lab reports of their products but offer counterfeit items as well. Buying from an established and reliable supplier like Mr. Hemp Flower means consuming high-quality, pure, safe, and tested D-10 THC. We protect you from fake and untested products all around.
We make our own goods using organic hemp sourced from experienced, USA-based local farmers. Our brand adheres to higher quality standards than brick-and-mortar stores that don’t have as high of demand. One of the biggest advantages of buying from an established hemp company is that you’ll know the methods they use to make their goods. Plus, is there anything better than buying directly from the maker.
If you’ve ever purchased a product from Mr. Hemp Flower, you know it’s our mission to protect you from falling prey to fake, untested and potentially harmful products.
Continued, Is Delta-10 THC Legal in California?
Hemp-derived Delta-10 THC is LEGAL in California.
California doesn’t explicitly prohibit the distribution and sale of D-10 THC. But, it’s California we’re talking about — things are a bit more complicated than that.
Delta-10 THC is hemp-derived, so its sale and distribution fall under the state hemp regulatory framework. And California has not been the best nor fastest at implementing hemp cannabidiol (CBD) laws.
State legislators have introduced several bills throughout the years, and all of them flopped. The California Department of Public Health prohibits the sale of hemp-CBD in food, beverages, and dietary supplements. On the bright side, the state doesn’t include hemp-derived products as part of its Controlled Substances list.
The Golden State legalized the manufacture, distribution, and sale of hemp and hemp derivatives, extracts, and cannabinoids — but also imposed a lot of restrictions. Many vendors stay away from shipping their products to California due to complicated tax issues and compliance with local provisions.
As of this writing (07/07/2021), the state is in the process of passing a bill that would limit the sale of hemp-derived THC isomers to marijuana dispensaries. We’ll see how that turns out.
Delta-10 THC and Federal Law
Is Delta-10 THC a synthetic tetrahydrocannabinol? Similar to Delta-8 THC, the legal complexities of this cannabinoid come from the way it’s manufactured.
The 2018 Farm Bill legalized hemp and all hemp derivatives, extracts, and cannabinoids extracted from material with less than 0.3% Delta-9 THC. This makes Delta-9 THC the only prohibited and restricted cannabinoid from hemp.
The issue here is how “natural” hemp THC is when derived from other hemp cannabinoids — as opposed to being extracted directly from the plant.
If you’ve been doing some research on D-10 THC, you know that the hemp plant doesn’t produce a meaningful supply of this cannabinoid. So, chemists produce it in a lab by rearranging the molecules of hemp-derived cannabidiol (CBD). It’s a unique process that includes the use of catalysts and potential conversion of CBD into Delta-9 and then Delta-10.
Compared to D-8 THC made via isomerization (conversion of one cannabinoid molecule into another), D-10 is more heavily processed. And that makes this compound semi-synthetic.
Because it’s derived from hemp cannabidiol, it is technically a hemp derivative. As such, it exists in a gray legal area and could be protected by the 2018 Farm Bill. The Drug Enforcement Administration (DEA) recently released a report which stated that all synthetically derived THC is a Schedule I substance on a federal level.
So, the question that prevails is: Is Delta-10 THC synthetic tetrahydrocannabinol? That’s up for debate. It’s a fact that D-10 THC is not extracted directly from the hemp plant in its organic state. But, it’s also far from truly synthetic, dangerous THC like Spice and K2 that provide an intense, life-threatening experience.
Until some clarification is provided, the legality of this cannabinoid is up in the air. Truly, Delta-10 THC exists in the grayest of the hemp laws in the nation.
