Delta-10 THC and Federal Law 

Is Delta-10 THC a synthetic tetrahydrocannabinol? Similar to Delta-8 THC, the legal complexities of this cannabinoid come from the way it’s manufactured. 

The 2018 Farm Bill legalized hemp and all hemp derivatives, extracts, and cannabinoids extracted from material with less than 0.3% Delta-9 THC. This makes Delta-9 THC the only prohibited and restricted cannabinoid from hemp. 

The issue here is how “natural” hemp THC is when derived from other hemp cannabinoids as opposed to being extracted directly from the plant. 

If you’ve been doing some research on D-10 THC, you know that the hemp plant doesn’t produce a meaningful supply of this cannabinoid. So, chemists produce it in a lab by rearranging the molecules of hemp-derived cannabidiol (CBD). It’s a unique process that includes the use of catalysts and potential conversion of CBD into Delta-9 and then Delta-10. 

Compared to D-8 THC made via isomerization (conversion of one cannabinoid molecule into another), D-10 is more heavily processed. And that makes this compound semi-synthetic. 

Because it’s derived from hemp cannabidiol, it is technically a hemp derivative. As such, it exists in a gray legal area and could be protected by the 2018 Farm Bill. The Drug Enforcement Administration (DEA) recently released a report which stated that all synthetically derived THC is a Schedule I substance on a federal level. 

So, the question that prevails is: Is Delta-10 THC synthetic tetrahydrocannabinol? That’s up for debate. It’s a fact that D-10 THC is not extracted directly from the hemp plant in its organic state. But, it’s also far from truly synthetic, dangerous THC like Spice and K2 that provide an intense, life-threatening experience. 

Until some clarification is provided, the legality of this cannabinoid is up in the air. Truly, Delta-10 THC exists in the grayest of the hemp laws in the nation.
