Unfortunately, hemp-derived Delta-10 THC is NOT legal in Alaska. 

The Last Frontier lists tetrahydrocannabinols and their isomers and salts of isomers as Schedule IIIA substances. Despite marijuana being legal in Alaska, the state has banned tetrahydrocannabinols regardless if derived from hemp or marijuana. 

The state does have some of the most restrictive laws in the nation when it comes to selling hemp-CBD products. Mainly, the state didn’t implement its pilot hemp program despite the passage of Senate Bill 6 which makes the manufacture and sale of hemp-derived products within the state illegal. 

However, the Last Frontier has no laws that prohibit the use of hemp CBD, so most consumers order products online. We hope to see hemp also being legalized in Alaska and products like hemp-derived D-10 THC regulated in no time. 

Delta-10 THC and Federal Law 

Delta-10 THC exists in a gray legal area on a federal level due to two main reasons:

  • It’s an intoxicating cannabinoid derived from hemp 
  • It’s made in a lab through chemical synthesis

This compound can be found in hemp, but in very tiny concentrations. Meaning, there are no hemp strains that naturally contain high levels of D-10 THC that would allow processors to extract the compound directly from the plant. Therefore, natural extraction would likely be a challenge and a waste of time and money. 

A better option is to create the compound in a lab using hemp cannabidiol (CBD) or Delta-9 THC and catalysts. This cannabinoid is more heavily processed compared to Delta-8, that’s converted through isomerization. Because it’s obtained via chemical synthesis, this compound is considered semi-synthetic. 

Although the Farm Bill of 2018 legalized hemp and all cannabinoids, it doesn’t impact the status of “synthetically derived” tetrahydrocannabinols. The same is confirmed by the DEA’s Interim Final Rule, which states, “all synthetically derived tetrahydrocannabinols remain Schedule I controlled substances.” 

However, the law doesn’t define the term “synthetic,” so it’s unclear whether these compounds should be placed in the same category with typical “synthetic” cannabinoids like Spice and K2.  

The other reason is the intoxicating nature of these compounds. As a substance that causes a mild “high,” Delta-10’s legality comes into question because of the nature of the hemp plant. 

The Farm Bill legalized hemp because it’s a different variety of Cannabis and doesn’t cause the same effects as marijuana. According to the U.S. Cannabis Council, a Farm Bill “loophole” doesn’t exist because the Act of 2018 didn’t legalize the production of intoxicating substances. And when a compound is intoxicating, it doesn’t matter where it’s derived from. 

The debate around the legality of these compounds continues as the industry awaits the release of the DEA’s verdict in the Final Rule.

As of this writing, Delta-10 THC is NOT legal to buy in the Last Frontier. Alaska classifies tetrahydrocannabinols as controlled substances, so their sale and possession is not allowed in the state.
